2019 QLS INSOLVENCY LAW MASTERCLASS

A well known (alleged) Shadow Director was recently overheard asking this question; “What is the difference between FEG and a rottweiler?” His answer, “A rottweiler will eventually let go!”.

 

With the assistance of the Law Council of Australia Insolvency Law Committee, the Queensland Law Society is presenting a Masterclass on Insolvency law next Tuesday, 20 August 2019 at Law Society House in Brisbane.

This Masterclass is aimed at experienced practitioners and works through complex legal scenarios and cases.

Michael Brennan, QLS Councillor and Principal of Offermans, will Chair the Masterclass.  A copy of the program and registration details are available here. Over a half day session, the Speakers will tackle the most pertinent issues facing insolvency lawyers today.

The NAB’s Vicky Biondo will run through the practical implications of the Amerind decision and what to do 

when faced with insolvent trustees.  Apparently, hiding under a blanket and hoping no one notices is not a viable option.

Scott Butler of McCullough Robertson, the Committee Chair, will tackle priority employee claims over circulating security interests.  Whilst some may think this is dull (how wrong you are), this vexing issue is being made all the more complex thanks to the 300 KG, insolvency gorilla called FEG.  A well known (alleged) Shadow Director was recently overheard asking this question; “What is the difference between FEG and a rottweiler?” His answer; “A rottweiler will eventually let go!”.

The Forge insolvency has been the gift that keeps on giving for insolvency lawyers.  HWL Ebsworth Specialist Litigator, Warren Jiear will be pulling apart the law of set-off and S.553C of the Corporations Act.  A wise man once said to me, “’set-off’ is an equitable concept, ‘off-set’ is a kind of type writer”.  Thankfully, Warren’s analysis will be much deeper, and probably funnier.

The final session of the day will be a Q&A for the speakers on everything you wanted to know about insolvency but were too busy to ask.
